The Town has been advised that the Appellate Court reversed the decision of the trial court that dismissed the applicant’s land use appeal and is directing the Planning & Zoning Commission to approve the applicant’s application to locate bulk storage of propane at 40 Ciro Road.    At the trial court, the Town successfully persuaded the judge that under a Connecticut Supreme Court decision, even when a proposed development is permitted as of right, a planning & zoning commission has discretion to inquire into specific matters, even if off-site, to make sure that the proposed site plan layout is safe.  In reversing the trial court, the Appellate Court held that the Town was limited to considering only on-site concerns. 

The Town Attorney will be meeting with the Planning & Zoning Commission in Executive Session to review the decision and explore any remaining options.  The deadline to file a petition for certification with the Connecticut Supreme Court is October 25, 2021.  The Town believes that even when something is permitted as of right, a planning & zoning commission should have the ability to balance all concerns, on-site and off-site, to protect the public health, safety and welfare, and to maintain a harmonious balance in land use.
